‘Truth will be revealed’: Gabby Petito’s dad celebrates after Laundries’ motion to dismiss lawsuit fails

FLORIDA’S SARASOTA COUNTY: After Sarasota County Court rejected a motion submitted by the parents of Brian Laundrie, Gabby Petito’s father posted a somewhat strange comment on Twitter.

The parents of the deceased YouTuber Petito have sued the family of her boyfriend. However, the Laundries’ attorney filed an appeal to have the civil case dismissed, which was now rejected.

 

The Laundries’ lawyer’s comment was likewise described as “objectively outrageous” in the official paper, which led to the conclusion that the Petitos’ “causes of action for deliberate infliction of emotional distress against the Laundries” were legitimate. According to reports, Judge Hunter W. Carroll was alluding to a statement made by the Laundrie family’s lawyer, Steven Bertolino, during the hunt for Gabby.

“On behalf of the Laundrie family, it is our desire that the hunt for Miss Petito is successful and that Miss Petito is reunited with her family,” Bertolino had said at the time. Although the Laundrie family allegedly knew that Gabby was deceased, Petito family attorney Patrick Reilly charged them in court with spreading false hope and creating emotional anguish through that remark.

The court order continued, “The Court concludes that Plaintiffs [Petitos] have stated causes of actions for intentional infliction of emotional distress against the Laundries because the Laundries’ statement by their attorney in the context of the particular facts of this case is objectively outrageous. The Court would have decided this issue in the Laundries’ favor based on the idea of legal responsibility if the facts of this case had involved silence without any affirmative action by the Laundries. However, they didn’t say nothing.

“Joe Petito and Nichole Schmidt, the parents of Gabby Petito, are appreciative of the thorough and well-reasoned decision of Judge Hunter W Carroll which denied the motion of Christopher Laundrie and Roberta Laundrie to dismiss the complaint filed against them,” the statement from Gabby’s family reportedly read after the judge’s announcement. This offers them the chance to move on with their claim for the emotional pain brought on by the Laundries’ actions.

“Joe and Nichole are interested in learning what the Laundries knew about Gabby’s death and whereabouts. They are especially interested in obtaining a copy of any correspondence, emails, or messages that were sent during the trying time when Gabby’s whereabouts were unclear. They anticipate the trial and are certain that the Laundries will ultimately be held accountable. Joe and Nichole ask that their privacy be respected at this time and declare that they do not wish to discuss this topic publicly.
